We at Faze2 Partners Ltd., Israeli company registration number 515320471, a member of the Ruby Capital group (“Ruby Capital“, “us“, “we“, or “our“) recognize and respect the importance of maintaining the privacy of visitors to our website (“Site“). This Privacy Notice describes the types of information we collect from you when you visit our Site and/or use the services available thereon (“Services“). This Privacy Notice also explains how we process, transfer, store and disclose the information collected, as well as your ability to control certain uses of the collected information. If not otherwise defined herein, capitalized terms have the meaning given to them in the Terms of Service, available at https://rubycapital.com/en/terms (“Terms“). “You” means any user of the Site and/or Services. Personal Data” means any information that refers, is related to, or is associated with an identified or identifiable individual, such as a name, address, phone number or email address, or as otherwise may be defined by applicable law. You are under no legal obligation to provide us with any such Personal Data. It is your voluntary decision whether to provide us with any Personal Data, but if you refuse to provide such information, we may not be able to provide you with the Services.

 

  1. Personal Data We Collect. We collect information from you when you choose to use our Site and/or Services in accordance with the way you use it, as follows:
  • Contact. When you send us a message through a contact form on our Site, we will collect your name, email address, phone number and the content of your message.
  • Participation in Conventions. When you share your personal data with us at conventions, lectures or other event, we will collect any data you will choose to share with us.
  • Automatically Collected Data. In addition, when you use the Site, certain information may be automatically gathered about your computer or mobile device, including non-Personal Data, such as your operating system, and Personal Data such as your IP address, device ID, as well as your use and/or browsing history and any information regarding your use, viewing history on our Site.
  1. How We Use Your Personal Data. You hereby agree and confirm that the company may store information collected about you, including Personal Data, in its databases. We will maintain the databases in accordance with applicable law, and use the databases as stated in the Privacy Notice, including for the following purposes:
  • Services and Adjustments. We and/or any of our trusted third-party subcontractors and service providers use the Personal Data we collect from and about you for any of the following purposes: (1) to provide you with the Site and/or Services; (2) to provide you with customer support; (3) to contact and communicate with you; (4) to respond to your inquiries or requests; and (5) to prevent fraud, protect the security of our Site and Services, and address any problems with the Site and/or Services.

 

  • Internal Purposes. We may use Personal Data collected about you to develop our Site and Services, conduct analyses to improve our Site and Services and adapt them to meet our needs and/or the needs of our customers, carry out financial assessments and forecasts, evaluate the potential use by our customers, use for research purposes, adjust the server capabilities to the expected scope of work, and review the usage and operations of our Site and Services.
  • Statistical Information and Analytics. We and/or our service providers use analytics tools to collect and analyze information about the use of the Site and/or Services, such as how often users visit the Site, what pages they visit when they do so, and what other sites and mobile applications they used prior to visiting the Site. By analyzing the information we receive, we may compile statistical information across a variety of platforms and users, which helps us improve our Site and Services, understand trends and customer needs and consider new services, and tailor existing services to customer desires. The data we collect is aggregated and anonymous and we will not connect it to any Personal Data.   1. Sharing the Personal Data We Collect. We share your information, including Personal Data, as follows:
  • Service Providers, and Subcontractors.
    • We disclose information, including Personal Data we collect from and/or about you, to our trusted service providers and subcontractors, who use such information to: (1) help us provide you with the Site and/or Services; and (2) aid in their understanding of how users are using our Site and/or Services. Such service providers and subcontractors provide us with IT and system administration services, data backup, security, and storage services, and data analysis.
  • By accepting this Privacy Notice, you acknowledge that we may use subcontractors and service providers who are located in countries other than Israel, and may send them information we collect (including Personal Data). These subcontractors and service providers shall be bound by confidentiality undertakings. Notwithstanding the foregoing, such service providers and subcontractors may be located in countries with a lower level of data protection compared to Israel.
  • Business Transfers. Your Personal Data may be disclosed as part of, or during negotiations of, any merger, sale of company assets or acquisition (including in cases of liquidation). In such case, your Personal Data shall continue being subject to the provisions of this Privacy Notice, in accordance with applicable law.

 

  • Law Enforcement Related Disclosure. We may share your Personal Data with third parties: (i) if we believe in good faith that disclosure is appropriate to protect our or a third party’s rights, property or safety (including the enforcement of the Terms and this Privacy Notice); (ii) when required by law, regulation subpoena, or a court order to disclose the identity, activity, content, or other personal information of any user who is suspected of engaging in illegal activities; or (iii) as is necessary to comply with any legal and/or regulatory obligation for example, to comply with audit and other legal requirements.
  • Additional Uses. We will share your personal data with relevant third parties in cases where: (1) we discover that any action you have taken in the Services violated the Terms or was done to commit fraud; or (2) we face any proceedings (criminal or civil) for actions you have taken using the Services.
  1. Security. We make efforts to follow generally accepted industry standards to protect the Personal Data submitted to and collected by us, both during transmission and once we receive it. However, no method of transmission over the Internet or method of electronic storage is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security. Subject to applicable law, you may request to see any Personal Data you have provided to us and request that such Personal Data be corrected or updated by emailing us at office@rubycapital.com. If and as applicable, we will correct your personal information in accordance with the applicable law within a reasonable time from receiving the request.

 

  1. Data Retention. Subject to applicable law, we retain Personal Data as long as necessary for: (1) the purposes set forth above; (2) compliance with our legal obligations; (3) resolving disputes; (4) enforcing our agreements; or (5) longer periods of time, for instance where we are required to do so in accordance with legal, regulatory, tax, audit, and accounting requirements and so that we have an accurate record of your dealings with us in the event of any complaints or challenges, or if we reasonably believe there is a prospect of litigation relating to your Personal Data or dealings. We may delete information from our systems without notice to you once we deem it is no longer necessary for these purposes.
